Backlog Kroxa and Nephalia Academy Interaction Bug

When Kroaxa's discard ability (it happened when escaped) causes me to discard a card with Nephalia Academy on the field I do not get the choice to put the card on top or not. This has happened twice now I believe.

I now realize that this is just a screen shot of next to nothing, Throes of Chaos was just discarded after Kroaxa escaped and now he is post discard triggering.
